The Texas Deceptive Trade Practices and Consumer Protection Act (DPTA) was enacted into Texas state law in 1973. It provides that a consumer may recover financial damages when wronged by false and misleading business practices and products. In addition, mental anguish damages can also be recovered if a judge or jury finds the Defendant’s conduct was intentional. The special damage provisions of the DPTA also provide consumers the ability to be awarded additional damages not to exceed three times the combined total of the financial and mental anguish damages.
